SANTA ANA, Calif. (KABC) -- Orange County Sheriff Don Barnes said Saturday that his deputies would not be enforcing the regional stay-at-home order that has been issued for Southern California.

"Compliance with health orders is a matter of personal responsibility and not a matter of law enforcement,'' Barnes said in a statement. "The Orange County Sheriff's Department will remain consistent in our approach.

The New York State Sheriffs’ Association has issued a statement blasting Gov. Andrew Cuomo over an executive order limiting private gatherings to 10 people ahead of the Thanksgiving holiday.

Officials in Onondaga County and Madison County said last week that they won’t be enforcing the rule as long as violations aren’t egregious. “There is no need to hide cars and sneak around during your attempt to gather with family,” Madison County Sheriff Todd Hood promised.

I’m a law enforcement officer; I enforce the laws — I don’t get to pick and choose,” Cuomo said Wednesday. “Well, I’m not going to enforce domestic violence laws because that’s a family affair? No. There’s a law and you have to enforce the law, or don’t call yourself a law enforcement officer.”

But the NYS Sheriffs’ Association said Monday it simply does “not have the resources nor the legal authority” to enforce the latest rule, despite a rise in coronavirus cases across the state.

“We find [Cuomo’s] comment ironic, and disingenuous, since the Governor has directed that his own State Police do not have to enforce the order,” the organization said in a statement addressed to all New Yorkers. “Apparently, it is another case of ‘do as I say, not as I do,’ such as we have seen with many other political leaders. He has also called Sheriffs ‘dictators’ for following the Constitution rather than his orders, which we also find ironic.”

Gavin Newsom’s regional approach. In San Francisco, Berkeley and Alameda County, the orders will take place at 12:01 a.m. Monday, with Santa Clara and Contra Costa at 10 p.m. Sunday and Marin at noon on Tuesday.

“We don’t think we can wait for the state’s new restrictions to go into effect. ... This is an emergency,“ Contra Costa Health Officer Chris Farnitano said during a virtual press briefing Friday.

Most of the counties have not yet reached Newsom’s threshold requiring the closures when 85% of ICU beds at regional hospitals are full. But officials said hospitals in the region will be overwhelmed in the coming weeks when Newsom’s order would apply.

Restaurants in those areas will have to close to indoor and outdoor dining, and bars and wineries must close along with hair and nail salons and playgrounds. Retail stores and shopping centers can operate with just 20% customer capacity. Gatherings of any size with people outside a household are banned.

Bay Area health officers held a meeting Thursday night to discuss the move. Ultimately, San Mateo County Health Officer Dr. Scott Morrow decided to not place further restrictions on the county until required under the state system. In a statement released Friday, San Mateo County officials cited an interest in working with businesses and residents to slow the surge.

“[T]he County of San Mateo remains focused on following the state’s existing metrics and process, while reinforcing the public’s responsibility to comply with existing safety measures — especially avoiding gatherings — to slow the spread of COVID-19 during the holiday season,” read the statement.

The new stay-at-home order will cut sharply into the most profitable shopping season and threaten financial ruin for businesses already struggling after 10 months of on-again, off-again restrictions and slow sales because of the pandemic.
