So a drunk driver rear-ended me on the freeway...

So a drunk driver rear-ended me on the freeway...
...luckily no one was hurt. I went home and the other guy went to jail.

The insurance co wants to settle. Here's my dilemma: they want to give blue book for the car which is a total loss. $4900 if I sign over the car to them, $3900 if I keep the car. Repair estimates are $8000-9000 and a second estimate is $17,000(???!!!).

Is there room to negotiate since the market value is around $6000. I want to keep the car but not at $3900. $4500 sounds fairer.

WHAT SAY YOU???!!!

(Please no advice from Matt Abbott or Ray Carlton)

I have a personal injury attorney....seeing a chiropractor right now. So there'll be money down the pipeline for that.

And he was yelling and screaming that it was my fault. I called the highway patrol and his whole demeanor changed. Just like Matt Abbott when I enter the room???!!!

.15 is pretty serious. You should probably get more compensation than just your CAR

think about the hassle of getting your car totaled.

if there is even a slight bit of pain/soreness, I would claim personal injury against this clown

he was drunk, rear ended you and was yelling at you at the same time?

is that how he got the DUI after you called the HP?

He was trying to get me to admit fault...even tried to hold hands to pray...

He quieted down when the police arrived. They smelled alcohol and noticed other stuff. Idiot admitted he had 5 shots of vodka but didn't "feel" he was inebriated.

DUIs in this state are expensive and the insurance co won't pay his auto damages...so if his car is totaled also, he's royally screwed.

YUP the pain intense. Neck, upper back, I have nerve damage (I feel pain in forearms and finger tips) and am walking slowly in pain.

To Matt Abbott this would be a good time to fight me???

This is is 2nd time I've been the victim of a car hitting my other car. 2017. Went to the same lawyer and chiropractor. I got $4000 out of $7000. And this was on city street at 30-35 miles an hour upon impact. This current one was on the freeway at a higher speed. Pain and suffering is a lot more on this one.

I don't usually like to be too dishonest but I also hate drunk driving. So in this case, I say fuck that guy. He could have killed somebody.

Yeah you have a lawyer send a demand letter to the insurance to get full blue book value. They will try to get you to enter arbitration if you call and deal with them, then begrudgingly give you 500 dollars more. Demand letter from a lawyer will get you 500-1000 over blue book value in this case. Every time your car gets totaled for any reason you do this to get max value. The law is that you must be made whole by the insurance company and that includes buying an identical car if you want. You are entitled to the full price to do this by law.

If you don't get a lawyer they will know you aren't serious about enforcing this law, and they will make you sign a contract for less than what the law allows. Only a lawyer can unlock the correct price.
