California colleges will be required to adopt rape-prevention policies that include a so-called “affirmative consent” standard before sexual activity under a new law signed by Gov. Jerry Brown (D) over the weekend.

The standard, also dubbed “yes means yes,” will require people to receive what the bill defines as “affirmative, conscious and voluntary agreement” from their partners before engaging in sexual activity. The legislation, sponsored by incoming state Senate President Kevin de Leon (D), aims to cut the prevalence of sexual assault on college campuses.

The law also says anyone asleep, unconscious or intoxicated is unable to give consent.

Sexual assault survivors groups delivered petitions with thousands of signatures to Brown’s office Sept. 16. The presidents of the University of California, California State University and California Community College systems all backed the bill, too.

“The State of California will not allow schools to sweep rape cases under the rug. We’ve shifted the conversation regarding sexual assault to one of prevention, justice, and healing,” de Leon said in a statement late Sunday.

The new law applies to all colleges and universities that accept any funding from the state. The policies those colleges must adopt will also be required to include victim-centered sexual assault response policies and prevention programs.

The bill was one of 48 Brown signed into law Sunday, two days before a Sept. 30 deadline requiring him to act on legislation passed this year.

California Governor Jerry Brown has signed a law designed to make it clear when sexual consent is mutual between students on California college campuses, as well as including guidelines for addressing sexual assault reports.

Lawmakers in the state concluded that the popular “No means No” slogan aimed at preventing sexual assault was not enough to prevent misunderstandings between adults, so passed a more pro-active measure, passing a historic “Yes means Yes” alternative instead.

“With one in five women on college campuses experiencing sexual assault, it is high time the conversation regarding sexual assault be shifted to one of prevention, justice and healing,” said State Senator Kevin de Leon (D-Los Angeles), the author of the bill, AP reported.

The legislation emphasizes that silence or lack of resistance does not constitute sexual consent. The law is designed to protect an individual who may be in a state of intoxication, unconscious or asleep, for example, and is therefore not in a position to grant consent.

“Affirmative consent,” the law says, “means affirmative, conscious and voluntary agreement to engage in sexual activity. It is the responsibility of each person involved in the sexual activity to ensure that he or she has the affirmative consent of the other or others to engage in the sexual activity. Lack of protest or resistance does not mean consent, nor does silence mean consent.”

“Every student deserves a learning environment that is safe and healthy,” De Leon said in a statement Sunday night. “The State of California will not allow schools to sweep rape cases under the rug. We’ve shifted the conversation regarding sexual assault to one of prevention, justice, and healing.”

The law, SB967, applies to all California post-secondary schools – both public and private – that receive state funding for student financial aid.

I believe it was inspired by sex on college campuses, where the participants are often drunk.

If drunken sex is now going to be only quasi-legal, you're opening a huge can of worms. I don't think it's exaggerating to say that 50% of sex on college campuses is drunken sex. That figure may be about right for all sex.
Brown is awesome. He's just like 'Fuck it, sure' for anything.

He's the dude that said if a boy felt like a girl at school, he jumps right in there with the girls, sports, change rooms, showers, everything. No questions asked.

yep. most of the time when people are dating for the first time alcohol is involved. alcohol is used because it lowers inhibitions which allows BOTH parties to be more relaxed.
this is a test pilot program for adoption into the wider society.

pretty soon they'll be drafting up written contracts before sexual encounters.

AHA! In a moment of clarity I figured it out:

They are pushing this consent stuff so hard because they want everyone to video every sexual encounter they ever have to prove it was consensual.

Basically free porn.

If you get accused, they get to see your video if you want to prove your innocence, so be careful to video all your sexual encounters, because one can never to too careful with these things!
